1. Object
These terms and conditions ("Terms of Use") govern the use of the CBRE Real Estate S.A. website except where special terms and conditions exist, accessed through the address
The Website has been created to disseminate and allow general access to all Internet users of legal age, who can make full use of their faculties, and especially to professionals in the real estate and services sector in creating global solutions for spaces, information, activities, and various services developed by CBRE.
Navigating the Website or its use in any form, confers the status of user, and implies full and unreserved acceptance of these Terms of Use.
CBRE, through its Website, provides its users with access to certain content made available by CBRE or by third-party providers of services and content. The user voluntarily accepts that the use of these is at all times under their sole and exclusive responsibility.
We may update these Terms of Use at any time, so we recommend you review them periodically, as you must comply with them and will be bound by them from the moment we publish them. If you do not agree with the Terms of Use, you should not use the Website.
2. Services
The Website offers users the following services listed below ("Services"):
2.1 Mortgage calculation
Users will be able to calculate a mortgage simulation, by accessing the section intended for this purpose on the Website, CBRE uses a third party for this and in no case can it be understood as an official evaluation, valuation, and mortgage simulation, users must always and at all times have the particular advice of professionals.
The user may:
(i) Calculate the value of the housing they could buy, in a specific province of Spain, according to their net monthly income and the initial amount contributed, redirecting them to the third party's website once they click on "Calculate" or,
(ii) Calculate the amount that the mortgage could amount to for a housing, attending to its value. The user must complete the information requested in the different phases, and when finished, their email will be requested to send the results. At the end, different options from various banking entities will appear.
2.2 Property appraisal
Users will be able to simulate the appraisal of a property, by accessing the section intended for this purpose on the Website, CBRE uses a third party for this and in no case can it be understood as an official evaluation, valuation, and simulation of an appraisal, users must always and at all times have the particular advice of professionals.
When accessing the simulator, the user must complete the fields of information requested and must click on "Accept", then the data of the appraisal simulation will be shown, and the user may download the documents that the simulator provides.
2.3 Online housing reservation
Users will be able to carry out the procedures for online reservation of the houses that CBRE advertises through the Website, which have online reservation enabled, for this, they must access the "Promotions" section and select the promotion that interests them and has the functionality of online reservation.
Once the promotion is selected, they must select the housing they wish to reserve online and click on the "Reserve" button, at which time the user will be redirected to CBRE's online reservation landing, where the documentation needed and the method of payment for the reservation will be indicated to the user, as well as access to the documentation that the user must sign in the online reservation process to review it; the user must click on "Start" to access the online reservation form, which must be filled with the requested information, ensuring it is correct, truthful, reliable, adequate, and does not impersonate any third party.
The user will receive in their email inbox - from the address provided in the form - a confirmation and instructions to continue with the process. The user must create a password for their profile, being solely responsible for keeping it and not sharing it with any third party, it must be secure; once the password is entered, they will have a determined time to continue and conclude the online reservation process; the time will be indicated on the screen.
The user will be indicated the documentation they have to upload to be able to continue with the buyer's data form. Once the data is completed and the required documents uploaded, the user will advance to the point where the contractual documents with their data are auto-generated, which they must digitally sign following the steps indicated by the system. Once the documentation is signed, it will continue to the payment section, where the user must include the transfer receipt and then proceed to the digital reservation contract signing.
The digital reservation contract must be signed digitally, the user must follow the indications provided for this purpose. Once the digital reservation contract is signed, the instructions for accessing the documentation from their private area will be shown to the user.
3. The user
CBRE grants the user a non-exclusive, non-transferable license to access and use the Website in accordance with the Terms of Use. Any use of the Website not permitted by these Terms of Use is strictly prohibited.
3.1 Guarantees
The user guarantees to CBRE that all the information and documentation provided for the use of the Website, contracting of the Services is true and accurate, being solely and exclusively responsible for informing CBRE of any inaccuracies in it.
3.2 User obligations
Users of the Website undertake to use the Contents - as described below - and the Services diligently, correctly, lawfully, and in accordance with the law, morals, public order, and these Terms of Use.
Users may only use the Website to:
(i) Navigate through it;
(ii) Make online reservations of housing;
(iii) Request information about the properties;
(iv) Simulate mortgages;
(v) Request property appraisals;
Any use other than those listed in the previous point is completely prohibited.
Additionally, users commit, by way of example but not limitation, to:
- Not use the Contents or the Services for purposes contrary to the Law, morals, or public order; not to reproduce, copy, distribute, allow public access, transform, communicate to the public or modify any type of Content of the Website, except with the express written authorization, on any medium, whether physical or digital, of CBRE or with express authorization, where applicable, of the legitimate owner of the rights on the aforementioned contents, and will assume the responsibilities that correspond to them for conducts or activities that in any way can be unlawful or harmful to the rights of third parties or that can harm, prevent, or limit the use of this Website by other users.
- Not use, distribute, reproduce, transform, communicate, reverse engineer, under any circumstances, the design and source code of the web pages of the Website.
- Not impersonate any other person, entity, or third party.
- Not engage in spamming, flooding, harvesting of email addresses or other personal information, spidering, screen scraping, database scraping, or any other activity with the purpose of obtaining lists of users or any other information, specifically including, property listings available through the Website;
- Not send chain mails or pyramid schemes through the Website;
- Not attempt to gain unauthorized access to other computer systems through the Website; or
- Not use the Website in any way that could damage, disable, overburden, or impair the Website or interfere with the use and enjoyment of the Website by third parties
Users will respond for damages of any kind that CBRE may suffer, directly or indirectly, as a consequence of the breach of current regulations or any of the obligations derived from the use of this Website.
4. Industrial and intellectual property
The user acknowledges that CBRE holds or has a license over all intellectual property rights, industrial or any other analogous, relating to the contents of the Website, understanding by Contents or Content, by way of example but not limitation, texts, photographs, designs, logos, images, sounds, videos, animations, recordings, computer programs, underlying databases, source codes, software, documents design and navigation structure and, in general, any intellectual creation existing on the Website, as well as the Website as a whole, as a multimedia artistic work. All titles and intellectual property rights, industrial or analogous of any licensed content included in the Website are owned by the corresponding owner of the same.
Improper use of the Contents of the Website will constitute an infringement of the rights conferred by the applicable regulations and may be prosecuted in accordance with the provisions of the same.
CBRE exclusively holds the exercise of the exploitation rights of the Contents in any form, and especially the rights of reproduction, distribution, public communication, and transformation.
The user may print, copy, or store in the cache memory on their hard drive, the information and images of the Website, provided that it is done for personal and private purposes, without commercial or distribution purposes, and without modifying, altering, or decompiling them. This faculty of personal use is recognized provided that the warnings to copyright and industrial property rights herein are respected intact, and does not imply the granting of any license to the user. Any other use of the Contents will require the express and written authorization of CBRE.
The consultation of Contents does not imply the transfer or granting of license of any kind on them.
In addition to Contents, the Website may include commercial names, trademarks, graphics, slogans, or similar used for the provision of the Services, owned by CBRE ("CBRE Trademarks"). No license is granted to the user over CBRE Trademarks or those of any third party.
The user commits to respect what is established here and to avoid any action that could harm CBRE, its collaborators, advisers, companies of its group, or clients, reserving CBRE the exercise of whatever means or legal actions correspond to it in defense of its legitimate rights.
4.1. Industrial and intellectual property of collaborators with the website
The ownership of copyright over articles, theses, doctrinal works, or other forms of collaboration with CBRE belongs to their authors. Their dissemination on the Website is carried out non-profit by CBRE and under the conditions mentioned in these Terms of Use.
5. Links
The function of the links, or third-party links, that appear on this Website is to redirect the user to web pages independent of the Website.
CBRE is not responsible for the contents accessed by virtue of these third-party links, nor for the modifications carried out on them, nor for the use made of them, nor for their technical availability, nor guarantees the absence of viruses or other elements in them that may produce alterations in the computer system (hardware and software), in the documents or files of the user, excluding any liability for damages of any kind caused to the user for this reason. In particular, any deal you have with the operators of such third-party web pages will be governed by the terms and conditions (if any) of the same.
CBRE will make its best reasonably possible efforts to avoid the existence on its Website of links to sites with illegal content, that promote illicit activities, racist or xenophobic, or that, in general, go against the principles of freedom and human dignity or violate the values and rights of people.
6. Privacy and cookie policy
The Website may use cookies. Cookies are small information files that are generated through the instructions that Web servers send to browser programs, and that are saved in a specific directory on the user's computer.
The use of them will be made in order to personalize their pages on the website and never to store personal data. 7. Liability
7.1 Limitation of liability of CBRE
The Website is provided "as is", that is "as is". CBRE excludes, to the maximum extent permitted by law, all warranties, whether express or implied (including, by way of example but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, and the use of reasonable care and skill). CBRE does not declare, guarantee, or assure that the Website is free from corruption, attacks, viruses, interference, hacking, or other security intrusions; nor can it guarantee the truthfulness, accuracy, timeliness, availability, and operability of its Contents, Services, the Website, and, therefore, expressly, excludes all types of liability for possible damages or losses of any kind that its users could suffer from the use of the same.
There is the possibility that there are errors, omissions, price changes, rental or other conditions, prior sale, leasing or financing, or withdrawal without notice of the information from the property listings on the Website. All projections, opinions, assumptions, or estimates contained in the Website are only illustrative, and may not represent the current or future performance of a property included in the list. You and your tax and legal advisors should carry out your own investigation of any property listed on the Website and any transaction contemplated in relation to it.
The user understands and accepts that they use the Contents, Services, the Website at their own risk and sole and exclusive responsibility.
In the event that the user has actual knowledge that the information to which a third-party link or the Content of the Website is contrary to the law, morals, or public order, they must immediately communicate it to CBRE through the email dsr@cbre.com. The notification must include the following information:
(i) Identifying data and contact method of the complainant or their legal representative.
(ii) Documentation accrediting their condition as the owner of the rights allegedly infringed.
(iii) Detailed account of the rights allegedly infringed by the Website or the third-party website, as well as its exact location within them.
(iv) An express statement by the complainant that the use of the contents has been carried out without the consent of the owner of the rights allegedly infringed.
7.2 Exemption from liability of CBRE
Nothing in these Terms of Use restricts the liability of CBRE in the event of death or personal injury occurring as a result of our negligence or fraudulent statement.
In no event shall CBRE be liable to the user for indirect, general, special, exemplary, or other damages (including, without limitation, damages for loss of profits, business interruption, file corruption, loss of business information or any other monetary loss) in connection with the Website, the Services or the Content in any way or in connection with the use, the inability to use, or the results of the use of the same, even if CBRE has been advised of the possibility of such damages. CBRE does not provide any warranty regarding the information provided by CBRE or third parties on the Website. Therefore, neither the user nor any third party may claim against CBRE in any way for the consequences deriving from the use made of the information on the Website, the Services, or the Content.
7.3 User liability
The user will indemnify and hold us harmless from all losses, costs, claims, demands, or expenses (whether direct or indirect) arising from (i) any claim relating to their possession or use of the Website or any part thereof, the Services, Content or CBRE or third-party Trademarks that are contrary to these Terms of Use, in any way, or any material or information that they send us that infringes the copyright or intellectual property rights or analogous of any third party; or (ii) their use or misuse of the Website, the Services, Content or CBRE or third-party Trademarks.
8. Modification and termination of services
CBRE reserves the right to modify, suspend or terminate the provision of its Services or Contents, in whole or in part, at any time, and without the need to notify users of the same.
9. Law and applicable jurisdiction
These Terms of Use shall be governed and interpreted in accordance with the laws of the Kingdom of Spain. Any controversy in relation to the Website or with respect to any matter of the Terms of Use, will be substantiated before the Spanish jurisdiction, submitting the parties to the Courts and Tribunals of Madrid (Spain), and their higher hierarchies, with express waiver of other jurisdictions if they had them and were different from those mentioned. In the event that the controversy derives from a real estate property included in the Services, the parties will submit to the jurisdiction indicated by the regulation in this regard.
